MonacHub Terms of Use
Version 1 · Published:
These Terms of Use (the "Terms") govern access to and use of the MonacHub mobile application, the MonacHub Pro mobile application and the website monachub.mc (together, the "Services"), operated by MonacHub, based in the Principality of Monaco ("MonacHub", "we", "us").
Part A applies to everyone. Part B applies in addition to people who use the MonacHub app to discover and book Venues ("Customers"). Part C applies in addition to professionals who use MonacHub Pro ("Venues").
By creating an account, or by using the Services as a guest, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Part A — General terms
A1. Definitions
- Venue: a restaurant, bar, shop or other professional listed on MonacHub and using MonacHub Pro.
- Customer: a person using the MonacHub app.
- Reservation: a request made through MonacHub to reserve a table, service or time slot at a Venue.
- No-Show Fee: the amount a Venue may charge, under the conditions in Part B, when a confirmed Reservation is not honoured.
- Content: any text, photo, video, voice recording, location, rating, comment, poll or other material posted through the Services.
- Payment Provider: Core by Carlo (Carlo, Monaco), the licensed payment service provider that registers cards and processes No-Show Fees.
A2. What MonacHub is — and is not
MonacHub is an intermediation platform. It lets Customers discover Venues, request Reservations, share plans with friends and communicate. The Venue, not MonacHub, provides the meal, service or experience you book. The contract for that service is formed between you and the Venue. MonacHub is not a party to it, does not guarantee the availability, quality, price or conformity of the Venue's services, and is not a restaurant, a payment institution or a travel agent.
Information about Venues (opening hours, menus, prices, photos, dress code, accessibility) is provided by the Venues themselves. We ask Venues to keep it accurate but cannot check it in real time.
A3. Eligibility
- You must be at least 18 years old and legally able to enter into a contract.
- Venues must be lawfully established professionals, and the person opening a MonacHub Pro account must be authorised to bind the business.
- You may not use the Services if you have previously been suspended or removed by MonacHub.
A4. Accounts
- Registration. You sign up with an e-mail address (or, where offered, a mobile number) verified by a one-time code, then choose a password, or with Sign in with Google / Sign in with Apple.
- One person, one account. Accounts are personal and non-transferable. A MonacHub (Customer) account cannot be used to sign in to MonacHub Pro, and vice versa.
- Accuracy. You must provide accurate information and keep it up to date.
- Security. Keep your password confidential. Biometric unlock is an on-device convenience, not a substitute for your password. Tell us at contact@monachub.mc immediately if you suspect unauthorised use. You are responsible for activity on your account until you do.
- Guest mode. You may browse MonacHub without an account. Guests cannot book, message or save places; guest sessions expire automatically after about 7 days.
- Minimum app version. For security we may require you to update to a minimum version before continuing to use the app.
A5. Community rules
You must not use the Services to:
- harass, threaten, insult, discriminate against or impersonate anyone;
- post Content that is illegal, sexually explicit, violent, hateful, defamatory, or that infringes anyone's rights (including photos of people without their consent);
- send spam, advertising or unsolicited commercial messages;
- make Reservations you do not intend to honour, book on behalf of someone without their agreement, or repeatedly fail to show up;
- declare a no-show that did not happen, or otherwise abuse the No-Show Fee mechanism (Venues);
- post false ratings or comments, or ratings of a Venue you have a conflict of interest with;
- interfere with the Services: scraping, bots, reverse engineering, probing for vulnerabilities, circumventing access controls, overloading our systems;
- share account credentials or sell, rent or transfer your account.
A6. Reporting, blocking and moderation
- You can block any user from their profile or from a conversation; the person is not told. You can report a user or conversation from the chat menu, giving a reason (harassment, spam, inappropriate content, impersonation, other).
- Our moderation team reviews reports and may warn, suspend or permanently remove an account, remove Content, or reverse a No-Show Fee. Suspended users cannot sign in; the person can write to contact@monachub.mc to contest the decision.
- We are not obliged to monitor Content proactively, but we may remove any Content that breaches these Terms or the law, and we cooperate with authorities where required.
- Published contact for abuse and safety concerns: contact@monachub.mc.
A7. Your Content
- You keep ownership of your Content. You grant MonacHub a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example resize) and display your Content for the purpose of operating the Services, for as long as the Content is on the Services and for the retention periods described in the Privacy Policy.
- You are responsible for your Content and confirm that you have the rights needed to post it, including the consent of any person who appears in it and of any guest whose details you enter.
- Ratings and comments on saved places are private to you and, if you choose, your friends. They must reflect your genuine experience.
- Clearing a conversation removes it from your view only. Other participants keep their copy.
A8. Intellectual property
The MonacHub name, logos, apps, website, design and software are protected by intellectual-property law and belong to MonacHub or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the apps on devices you own or control, for your personal (Customers) or internal business (Venues) use, in accordance with these Terms. Map data is provided by Mapbox and its data sources and is subject to their terms; the attribution shown on the map must not be hidden.
A9. Third-party services
The Services rely on third parties (Apple, Google, Supabase, Mapbox, AppsFlyer, Sentry, Firebase, Core by Carlo). Their own terms apply to your use of their services (for example the Payment Provider's terms when you register a card, or Google's or Apple's terms when you sign in with them). We are not responsible for services we do not operate.
Apple users. These Terms are between you and MonacHub only, not Apple. Apple has no obligation to provide maintenance or support for the apps and is not responsible for any claim relating to them (product liability, legal or regulatory compliance, intellectual property). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must comply with applicable third-party terms when using the apps.
A10. Availability, updates and changes to the Services
We aim to keep the Services available at all times but do not guarantee uninterrupted access. We may suspend the Services for maintenance, security or legal reasons, and may add, change or withdraw features. We will give reasonable notice of changes that materially reduce the Services, except where immediate action is needed.
A11. Suspension and termination
- By you: delete your account at any time from Profile → Delete account, or as described in the Privacy Policy. Reservations that are still pending or confirmed remain subject to the Venue's cancellation and No-Show Fee rules until cancelled or honoured.
- By us: we may suspend or terminate your access, with notice where reasonably possible, if you breach these Terms, if your account is used for fraud or abuse, if a No-Show Fee remains unpaid after our retry attempts, if required by law, or if we discontinue the Services. Where a suspension is contested, write to contact@monachub.mc.
- Sections A7 (licence for retained content), A8, A12, A13 and A15 survive termination.
A12. Warranties
The Services are provided "as is" and "as available". To the extent permitted by law we make no warranty that they will be error-free, that Venue information is accurate, or that a Reservation will be accepted. Nothing in these Terms limits the rights you have as a consumer under the mandatory law of your country of residence.
A13. Liability
- MonacHub is liable for direct damage caused by its proven fault in operating the Services. Our liability to Customers is limited to the amount of the No-Show Fees paid through the Services in the 12 months before the event giving rise to the claim, or EUR 100 if higher. This limit does not apply to death, personal injury, gross negligence, wilful misconduct, or to any liability that cannot be limited under applicable law.
- MonacHub is not liable for the acts or omissions of Venues or other users, for the quality of a Venue's services, for a Venue's decision to accept, decline or cancel a Reservation, or for content posted by users.
- Venues (Part C) indemnify MonacHub against claims arising from their listings, their services, their tax obligations and wrongful No-Show Fee declarations.
A14. Changes to these Terms
We may amend these Terms. We will notify you in the app or by e-mail at least 30 days before material changes take effect, except where a change is required by law or is needed urgently for security. If you do not agree, delete your account before the change takes effect; continuing to use the Services afterwards constitutes acceptance.
A15. Governing law and disputes
- These Terms are governed by the law of the Principality of Monaco. If you are a consumer residing in the European Union, you also benefit from the mandatory consumer-protection rules of your country of residence.
- Before any court action, please write to contact@monachub.mc; we will try to resolve the matter within a reasonable time (generally 30 days).
- Subject to mandatory rules that give consumers the right to sue or be sued in their own country, the courts of the Principality of Monaco have exclusive jurisdiction.
A16. Miscellaneous
These Terms, the Privacy Policy and any Venue-specific conditions shown before you book form the entire agreement. If a provision is held invalid, the rest remains in force. We may assign these Terms to a successor of our business; you may not assign them. These Terms exist in English and French; in case of discrepancy the French version prevails.
Part B — Customers: reservations and no-show fees
B1. Making a Reservation
- Choose a Venue, a date, a time slot and a party size, add an optional note (occasion, preferences) and, if you wish, invite guests. Guest invitations may be sent to MonacHub friends, groups, or as a link.
- Your request is pending until the Venue responds. Each Venue sets a response window (currently 2 hours by default, shown when you book). If the Venue does not respond in time, the request lapses and you are told.
- A Reservation is binding on both sides only once the Venue has confirmed it.
- Confirmed Reservations appear in your Agenda and can be added to your device calendar.
- If a Venue has enabled No-Show Fees, you must register a payment card before the request is sent (see B4). Nothing is charged at booking.
B2. Visibility, guests and links
- Private: only you and the Venue see the Reservation.
- By invitation: the people you invite see it and can accept or decline. As host you can add or remove guests; the Venue may need to re-confirm if the party size changes.
- Public / shared link: anyone with the link can see the Reservation summary and request to join; you decide who joins. Do not share links with people you do not trust.
- Guests who are not MonacHub users are managed by you; you are responsible for the details you enter about them.
B3. Changes and cancellations
- By you: you can cancel from the Reservation screen. Cancellation is irreversible. Cancellation is free of charge as long as it is made before the Venue's free-cancellation deadline (shown before you book; currently between 1 and 24 hours before the slot). After that deadline, a Venue that has enabled No-Show Fees may treat the Reservation as a no-show (B4).
- By the Venue: a Venue may decline a request or, for a legitimate reason (closure, force majeure, safety, breach of these Terms), cancel a confirmed Reservation. You are notified immediately. No fee is ever charged for a Reservation cancelled by the Venue.
- Automatic completion: a Reservation is marked completed shortly after its end time unless the Venue has declared a no-show.
B4. No-Show Fees
- What it is. A No-Show Fee is a fixed amount set by the Venue, currently between EUR 10 and EUR 50 (typically EUR 25), that may be charged when a confirmed Reservation is neither honoured nor cancelled before the free-cancellation deadline. The amount and the deadline are shown before you confirm the request, and you accept them by sending the request. It is not a deposit and not a prepayment.
- Card registration. To book at such a Venue you register a payment card on the secure page of our Payment Provider, Core by Carlo. Its terms apply to the registration. MonacHub never sees your full card number. You can manage your cards in Profile → Payment methods.
- When it can be charged. Only if all of the following are true: the Reservation was confirmed; you did not cancel before the free-cancellation deadline; the Venue declared the no-show within the declaration window that opens after your slot time; and the Venue has not recorded your presence.
- Dispute. You are notified as soon as a no-show is declared. You have at least 48 hours to contest it at contact@monachub.mc (for example: you were present, the Venue was closed, force majeure). MonacHub reviews the case and may reverse the declaration. A Venue may also correct its own declaration.
- Charge and receipt. After the dispute window, the fee is charged to your registered card by the Payment Provider and you receive a receipt. The fee is collected for the Venue; where the Venue has not yet opened its payout account, MonacHub collects it on the Venue's behalf and remits it.
- Failed payments. If the charge fails, we retry a limited number of times. While a No-Show Fee remains unpaid you cannot make new Reservations at Venues that apply No-Show Fees; you can settle it from the app.
- Refunds. A fee charged in error is refunded to the same card. Fees are not refundable otherwise.
- Presence. Arrive on time and check in with the Venue. If the Venue cannot seat you despite a confirmed Reservation, tell us at contact@monachub.mc; no fee is due in that case.
B5. Prices and payment at the Venue
Prices shown on MonacHub are indicative, provided by the Venue, and include applicable taxes unless stated otherwise. Payment for the meal or service is made directly to the Venue, under the Venue's own conditions. MonacHub does not process those payments.
B6. Social features
Friends, groups, chats, polls, shared locations and saved places are provided to organise outings. Share your location only with people you trust; it is stored in the conversation and visible to all participants. Use the block and report tools described in A6 for any problem.
Part C — Venues: professional terms (MonacHub Pro)
C1. Onboarding and verification
- You create a MonacHub Pro account, describe your establishment and provide your legal information (legal name, legal form, registration number, address). MonacHub may ask for supporting documents and may refuse, suspend or deactivate a listing that is inaccurate, unlawful or does not meet our quality standards.
- To receive No-Show Fees you must open a payout account with the Payment Provider, which requires identity, company and bank (IBAN) documents under anti-money-laundering rules. The Payment Provider's terms apply. Until your payout account is active, No-Show Fees are collected by MonacHub on your behalf and remitted to you.
C2. Your listing
- You are responsible for the accuracy and lawfulness of everything on your listing: name, address, opening and special hours, menus, dishes, prices (including taxes), photos, services, dress code, accessibility, categories.
- You must own or hold the rights to all photos and texts you upload and must not upload images of people without their consent.
- You must comply with the rules applicable to your business (licences, hygiene, consumer information, price display, allergen information).
C3. Handling Reservations
- Respond to requests within your response window (default 2 hours; configurable). Requests that lapse count against your responsiveness.
- Honour confirmed Reservations. Cancel only for a legitimate reason and as early as possible; repeated cancellations may lead to suspension.
- Record the Customer's presence (check-in, table) so that the Reservation completes correctly.
- Use the Reservation data you receive (name, party size, note, allergens and preferences, contact details) only to serve that Reservation. You are the independent controller of this data under Monaco Law n° 1.565 and, where applicable, the GDPR: keep it confidential and secure, do not use it for marketing without the Customer's consent, do not transfer it to third parties except as needed for the service, and delete it when no longer needed.
C4. No-Show Fee rules for Venues
- You may enable No-Show Fees for your establishment and set: the fee amount (currently EUR 10 to 50), the free-cancellation delay (currently 1, 2, 6, 12 or 24 hours before the slot), and how long before the slot presence can be confirmed. These settings are shown to Customers before they book and apply only to Reservations requested after the change.
- Declare a no-show only when the Customer genuinely did not come, within the declaration window that opens shortly after the slot time. Ignoring a no-show is always allowed. Declarations made outside the window are rejected.
- Customers may dispute within the dispute window (currently 48 hours) and MonacHub may reverse a declaration. You may correct your own declaration; a Reservation marked completed can be corrected to a no-show from the History screen within the correction window shown in the app (currently 48 hours), without any fee being charged.
- Wrongful or abusive declarations (Customer present, establishment closed, Reservation cancelled by you) are a serious breach: MonacHub refunds the Customer, may charge back the amount to you, and may suspend your access.
- Fees are collected by the Payment Provider net of its own charges, as set out in its terms, and paid into your payout account according to its schedule. MonacHub currently charges Venues no fee for this service; any change will be notified at least 30 days in advance.
- You are responsible for declaring and paying any taxes due on amounts you receive.
C5. Team members
You can invite team members by e-mail and assign roles. You are responsible for their use of MonacHub Pro and must revoke access when a person leaves.
C6. Fees for MonacHub Pro
MonacHub Pro is currently provided free of charge. We may introduce subscription or commission fees with at least 60 days' notice; you may terminate before they take effect.
C7. Termination
You may close your MonacHub Pro account at any time from Profile → Delete account. Pending and confirmed Reservations must be honoured or cancelled with notice to Customers before closure. MonacHub may terminate for breach as described in A11. Reservation and payment records are retained for the legal periods described in the Privacy Policy.
C8. Liability and indemnity
You are solely responsible for the services you provide to Customers, for your listing, and for your No-Show Fee declarations. You indemnify MonacHub against any claim, loss or cost arising from them, including wrongful declarations and tax liabilities.
